High Court in Mukono has dismissed the petition challenging the election of the Late Ffeffeka Sserubugo, the former district LC5 chairperson of Kayunga.
Boniface Musisi Bandikubi petitioned court challenging the victory Sserubogo on grounds that he was illegally nominated and lacked necessary academic qualifications for the position.
Justice Olive Kazaarwe Mukwaya made a ruling throwing out the application on grounds that none of the petitioner and the respondent together with their lawyers showed up before court.
She also based on the notice of withdrawal that was later submitted by Bandikubi and attached to the application.
Sseruboga passed away a month after swearing in as the Kayunga district chairperson. He won the competition of nine with 27878 votes on the National Unity Platform ticket, the petitioner emerged third with 2712 votes before running to court.
In the petition, Bandikubi accused Sserubogo for not presenting his ‘O’ level academic particulars yet he indicated on the EC form that he attended Namagabi SS and obtained Uganda Certificate of Education.
He further indicated that in the absence of the UCE slip, the Uganda Advanced Certificate of Education-UACE slip he obtained from Bilal Islamic SS lacks academic foundation yet it is the prerequisite for one to stand for the position.
The petitioner also accuses Sserubogo for swearing a deed poll denouncing his name of ‘Muhammad’ adopting a new one of ‘Ffeffeka’ yet it does not appear anywhere on his academic documents.
He made prayers before court to annul the EC’s decision before forcing it to organize a by election for Kayunga LC5 position.
