The High Court of Mukono slated August 26 for the cross examination of Mark Muganzi Mayanja, the Mukono District Electoral Commission Returning Officer over irregularities manifested during the election of Kasawo Town Council LC3 Chairperson.
Lady Justice Olive Kazaarwe Mukwaya set the date following a petition filed by Andrew Kabugo Kaddu challenging the victory of Joseph Mulindwa who was declared winner of the position.
Kaddu challenge the EC for nominating Mulindwa illegally. He cites out results from two polling stations of Kitalya-Busiya A-M and Kitalya Busiya N-Z that were added to results of Kasawo giving victory to Mulindwa yet they belong to Namuganga sub county.
The petitioner also indicate that EC nominated the winner yet he was also coming from Kitalya a village in Namuganga sub county.
Isaac Natala, the petitioners lawyer says wants court to declare her client a winner since results indicate that he was leading the race before the EC added results from the two polling stations.
Natala also want EC to explain how it ended up considering results from polling stations that were gazatted in a different sub county by the time of elections.
Mulindwa, the respond says is not scared about the application since he was diligently voted by people through proper set procedures.
The Electoral Commission’s lawyer Hamidu Lugoloobi says they have prepared their defense.
