Tororo High Court Resident Judge Henry Kawesa Isabirye has directed the management of Busamba government primary school to allow a 13-year-old expectant pupil to continue with her education following her dismissal.
In June of this year, the school, located in Busia District, expelled the minor, accusing her of being pregnant.
In response, the girl’s father, David Wafula, sought assistance from Women with a Mission, a non-governmental organization based in Namatala, Mbale City Industrial division, to advocate for his daughter’s rights.
Women with a Mission subsequently sued the school at Tororo High Court for infringing on the rights of the girl child.
On Friday, Justice Isabirye ordered the school to allow the teenager to continue with her education,
Speaking at a press conference at Courts View Hotel in Mbale on Monday, Betty Balisalami, the executive director of Women with a Mission, expressed satisfaction with the court’s ruling.
She noted that many schools and higher education institutions continue to expel pregnant girls, adversely affecting their education, despite government directives urging schools to allow pregnant students to remain in class.
Wafula expressed his gratitude for the court’s decision and the support provided by Women with a Mission, stating that his daughter has received justice and will now be able to continue her education, even as her defiler remains at large.
He emphasized his hope for his daughter’s future, as she is their only girl child.
Wafula reiterated his commitment to support her education, even after she gives birth to the child she is currently carrying.
