Molly Katanga, accused in the murder case of her husband Henry Katanga, was left desperate as High Court Judge Isaac Muwata denied her bail application.
The decision, reached on Tuesday, came amidst heightened tensions and legal arguments from both sides.
This article delves into the case details and the factors influencing the judge’s ruling.
Last Wednesday, the courtroom witnessed intense security measures as a group of individuals, adorned in black t-shirts bearing the accused’s portrait, attempted to disrupt proceedings in protest against the bail hearing.
Despite this disturbance, the court proceeded with the hearing, which, ultimately, led to Molly Katanga’s bail being denied by Judge Muwata.
Legal Arguments, Sureties
During the bail hearing, arguments were presented by both the defence and prosecution.
Legal representatives Peter Kabatsi, MacDosman Kabega, Elison Karuhanga, John Jet Tumwebaze, and Bruce Musinguzi advocated for Molly’s release on bail, citing her constitutional right to presumption of innocence and the presence of substantial sureties.
Notable among these sureties were John Patrick Kaboyo, Geoffrey Kamuntu, Maj. Gen (rtd) Emmanuel Nyamunywanisa, and Margaret Mugisa Muhanga.
However, Assistant Director of Public Prosecutions (DPP) Samali Wakooli, along with chief state attorneys Jonathan Muwaganya and Anna Kiiza, argued against Molly’s release on bail.
They referenced legal precedents, including the case of Uganda versus Francis Onebe, to support their stance that bail would be against the interests of justice.
The prosecution raised concerns regarding the suitability of certain sureties, specifically questioning the fitness of Kaboyo and Nyamunywanisa due to their advanced age and the potential burden of court processes.
Additionally, Kamuntu’s eligibility as a surety was challenged due to ongoing investigations related to obstruction of justice.
Case Background
The case revolves around the tragic death of Henry Katanga, a well-known businessman, who succumbed to a gunshot wound sustained during an alleged altercation with his wife, Molly, at their residence on November 2, 2023.
Prosecutors accuse Molly of killing her husband with malice aforethought, citing evidence including DNA analysis linking her to the murder weapon, gunpowder residue on her hands, and tampering with CCTV footage at the scene.
